Under the supervision of the Enforcement Branch Chief, this position is responsible for enforcement of the provisions the Business and Professions Code and the California Code of Regulations as they pertain to the Division of Measurement Standards’ programs.
This position is designated under the Conflict of Interest Code. The position is responsible for making or participating in the making of governmental decisions that may potentially have a material effect on personal financial interests. The appointee is required to complete Form 700 within thirty (30) days of appointment, on an annual basis, and upon vacating the position. The incumbent must complete an Ethics orientation training course within six months of assuming a Form 700 covered position, and every two (2) years thereafter, by December 31 of each numbered year. Failure to comply with the Conflict of Interest Code requirements may void the appointment
Enforcement and Investigation:
Incumbent may perform one or more of the following tasks based on assignments as directed:
• Responsible for County investigation programs of larger, regional, or statewide enforcement of fraud and product quality violations. This requires writing and presenting investigative reports, gathering, and evaluating the facts and evidence, locating and interviewing witnesses, taking statements and dispositions, providing and securing other expert support, and providing advice regarding test methods, scientific principles, business practices, and other technical and legal requirements contained in weights and measures laws.
• Determine the appropriate investigative scope and legal remedy for violations of weights and measures laws. Provide the necessary details and instructions for successful participation by other investigators, and direct them as needed, to complete a proper investigation.
• Confer with and support County District Attorneys and the California Attorney General, provide legal expertise on the accuracy of bulk commodity measurements depicted on weighmaster certificates, mislabeled, contaminated or adulterated automotive products, the use of unapproved or inaccurate weighing, measuring, or counting devices, unlicensed service agents, inaccurate quantity statements and labels on packaged items and inaccurate pricing on items sold. Identify and document fraudulent or negligent use, and the resulting harm to consumers. Present investigatory reports confirming violations found in the marketplace.
• Ensure compliance through criminal and civil actions as specified by the Business and Professions Code.

The duties of this position are generally performed at the Division of Measurement Standards Sacramento, Anaheim, and Fresno offices. Statewide travel is required for investigations, prosecutions, compliance examinations, license sweeps, or other duties as assigned. Occasionally irregular work hours are required. Contact with difficult or irate individuals may occur. There are times when assignments dictate working in extreme weather conditions or in physical locations that are cramped, unlit, or possibly hazardous environments requiring the use of Personal Protective Equipment.
Regular or recurring telework may occur as part of the incumbent’s ongoing regular schedule in accordance with CDFA’s Telework Policy.
